Welcome to IHIC Co.! In His Image Creations, operating under the brand name IHIC Co. (“IHIC Co.,” “we,” “us,” or “our”), operates this store and website, including its information, content, features, tools, products, and services, to provide customers with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

SECTION 1 — ACCESS AND ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state of residence or that you have authorized any minor dependents under your supervision to use the Services on devices you own or manage.

You may be asked to provide information such as your name, email address, billing address, shipping address, and payment information. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make every reasonable effort to represent our products accurately. However, colors and product appearance may vary slightly because of lighting, photography, display settings, and the device used to view the store.

Many IHIC Co. products are handmade, finished, or assembled in small batches. Minor variations in color, placement, texture, measurements, or finish may occur and are part of the handmade nature of the product. These minor variations are not considered defects.

Customers are responsible for reviewing and accurately submitting all names, wording, dates, colors, and other details requested for personalized products. IHIC Co. is not responsible for errors contained in information submitted or approved by the customer.

Product descriptions, prices, availability, specifications, and designs may be changed without notice. We reserve the right to discontinue products or limit quantities available to any person, household, geographic region, or jurisdiction.

Digital products are licensed to the original purchaser for personal, noncommercial use unless the applicable product listing expressly states otherwise. Digital files may not be shared, copied, reproduced, resold, redistributed, sublicensed, uploaded to file-sharing platforms, or used to create products for resale.

Purchasing a digital product does not transfer ownership of the design, content, copyright, trademark, or other intellectual-property rights.

SECTION 3 — ORDERS

When you place an order, you are offering to purchase the selected products. We reserve the right to accept, decline, limit, or cancel an order for reasons including suspected fraud, product unavailability, pricing errors, payment issues, or violation of these Terms.

An order is not accepted until payment has been successfully processed and we confirm the order. If we decline, modify, or cancel an order, we will attempt to notify you using the contact information provided during checkout.

Please review your order carefully before submitting it. Cancellation requests should be sent promptly to hello@ihicco.com. We cannot guarantee cancellation after production, personalization, fulfillment, or digital delivery has begun.

Personalized or customized products cannot ordinarily be changed or canceled after production begins. Digital orders cannot be canceled after the purchased files or access instructions have been delivered.

Products purchased through the store are intended for personal or household use and may not be purchased for unauthorized commercial resale or export.

SECTION 4 — PRICES, BILLING, AND PAYMENT

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is placed, subject to correction of evident errors.

Unless otherwise stated, listed prices do not include applicable taxes, shipping, or handling charges. These amounts will be displayed during checkout when applicable.

Promotional offers may have separate terms and expiration dates. If promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.

You agree to provide accurate and complete purchase, billing, payment, and account information. You represent that you are authorized to use the selected payment method and agree to pay all authorized charges associated with your purchase.

We reserve the right to correct pricing or product-information errors and to cancel affected orders. If an order is canceled after payment has been collected, the applicable amount will be refunded to the original payment method.

SECTION 5 — SHIPPING AND DELIVERY

Processing and delivery timeframes are estimates and are not guaranteed. Shipping delays may occur because of carrier disruptions, weather, holidays, incorrect addresses, or circumstances outside our reasonable control.

IHIC Co. currently ships physical products within the United States only. Digital products are delivered electronically and do not require physical shipping.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their content—including our business names, logos, product names, product designs, digital files, written content, photographs, graphics, videos, audio, page designs, and arrangement of content—are owned by or licensed to IHIC Co. and are protected by applicable intellectual-property laws.

The Services are provided for personal, noncommercial use. Unless we provide written permission, you may not reproduce, modify, distribute, publish, publicly display, transmit, store, sell, resell, license, create derivative works from, or commercially exploit our content or products.

Nothing in these Terms grants you ownership of or a license to any copyright, trademark, design, trade name, or other intellectual property belonging to IHIC Co., Shopify, or another party, except for the limited personal-use license expressly provided with an eligible digital product.

IHIC Co.’s names, logos, product names, designs, and slogans may not be used without prior written permission. Shopify’s names, logos, products, and services remain the property of Shopify. Other names and trademarks displayed through the Services belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools or services offered by third parties. We do not necessarily monitor or control these third-party tools.

Access to optional tools is provided “as is” and “as available,” without warranties, representations, endorsements, or conditions from IHIC Co. Your use of an optional tool is at your discretion and may be governed by the third party’s own terms and privacy policy.

We may introduce new tools, resources, or features in the future. Those additions will be considered part of the Services and will be subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

The Services may include links to websites, applications, or platforms operated by third parties. We are not responsible for evaluating or guaranteeing the content, products, services, security, availability, or accuracy of third-party platforms.

If you leave our Services to access a third-party platform, you do so at your own discretion. Review the third party’s terms, policies, and practices before providing information or completing a transaction.

Questions or complaints concerning a third party’s products or services should be directed to that third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

IHIC Co. is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and IHIC Co.

By using the Services, you acknowledge that Shopify is not responsible for sales between you and IHIC Co., including injury, loss, or damage associated with products or services purchased from IHIC Co.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or relating to purchases and transactions made directly with IHIC Co.

SECTION 10 — PRIVACY

SECTION 11 — FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit reviews, ideas, suggestions, photographs, comments, or other content to us (“Feedback”), you represent that you own or have permission to submit that Feedback.

You grant IHIC Co. a worldwide, nonexclusive, royalty-free license to use, reproduce, modify, publish, distribute, and display the Feedback for operating, improving, and promoting the Services.

You must disclose any compensation or incentive received in connection with a review or submission. Feedback may not violate another person’s copyright, trademark, privacy, publicity, or other rights and may not contain unlawful, abusive, defamatory, obscene, fraudulent, or malicious material.

You may not use a false identity or misrepresent the source of Feedback. You remain responsible for the content and accuracy of your submissions.

We may monitor, edit, decline, or remove Feedback that we reasonably believe violates these Terms or applicable law. Unless otherwise required by law, we are not obligated to keep Feedback confidential, compensate you for it, publish it, or respond to it.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS

Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, prices, promotions, shipping costs, transit estimates, availability, or other information.

We reserve the right to correct errors, update information, or cancel affected orders when information is inaccurate, including after an order has been submitted. If we cancel a paid order because of an error, we will refund the applicable amount to the original payment method.

SECTION 13 — PROHIBITED USES

You may use the Services only for lawful purposes. You may not use the Services to:

Violate applicable federal, state, or local laws;
Infringe our intellectual-property rights or the rights of another party;
Harass, threaten, abuse, defame, discriminate against, or harm another person;
Submit false, fraudulent, or misleading information;
Transmit malicious code, viruses, or harmful technologies;
Send unauthorized advertising, spam, phishing messages, or similar solicitations;
Impersonate another person or entity;
Collect or track another person’s information without authorization;
Interfere with or circumvent security, access controls, or technical restrictions;
Scrape, extract, reproduce, duplicate, resell, or exploit the Services without authorization; or
Engage in conduct that restricts another person’s use of the Services or exposes IHIC Co., Shopify, or others to harm or liability.

We reserve the right to restrict, suspend, or terminate access when we reasonably determine that these Terms have been violated.

For purposes of this section, an “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of a person or entity.

An Agent may not access or interact with the Services in a deceptive manner, conceal that it is automated, imitate human behavior to bypass access controls, circumvent CAPTCHAs, or evade measures intended to control automated access.

We may use technical measures to limit or control how automated Agents access and interact with the Services. Agents must comply with applicable technical instructions and identify themselves truthfully when required.

SECTION 15 — TERMINATION

We may restrict, suspend, or terminate your account or access to all or part of the Services if you violate these Terms, misuse the Services, create risk or liability, or engage in fraudulent or unlawful activity.

You remain responsible for authorized amounts incurred before termination.

Provisions that by their nature should continue after termination—including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Governing Law, and Privacy—will remain in effect.

OR REQUIRED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, OR NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS. IN THOSE JURISDICTIONS, THESE EXCLUSIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.

Nothing in these Terms limits any warranty or consumer right that cannot legally be excluded.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IHIC CO. AND ITS OWNERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST DATA, OR REPLACEMENT COSTS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF WE WERE ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

SOME JURISDICTIONS DO NOT PERMIT CERTAIN LIMITATIONS OF LIABILITY. IN THOSE JURISDICTIONS, OUR LIABILITY WILL BE LIMITED ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes liability that cannot legally be excluded.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless IHIC Co., Shopify, and their respective owners, affiliates, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

Your material breach of these Terms;
Your unlawful or unauthorized use of the Services; or
Your violation of another party’s rights.

We will provide reasonable notice of an indemnifiable claim. You agree to cooperate in the defense of the claim. We will not agree to a settlement that imposes a nonmonetary obligation on you without your consent, which will not be unreasonably withheld.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will remain valid and enforceable.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not waive that right or provision.

These Terms and the policies incorporated into them constitute the entire agreement between you and IHIC Co. concerning your use of the Services and supersede prior communications or agreements concerning the Services.

Any ambiguity in these Terms will not automatically be interpreted against the drafting party.

SECTION 21 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations as part of a business reorganization, sale, transfer, or other lawful transaction, subject to applicable law.

SECTION 22 — GOVERNING LAW

These Terms and any separate agreements through which we provide Services will be governed by and construed according to the laws of the State of Texas and applicable federal laws of the United States, without regard to conflict-of-law principles.

Any dispute will be subject to the jurisdiction of the appropriate state or federal courts located in Texas, except where applicable law provides otherwise.

Changes will apply from the effective date stated in the updated Terms. Continued use of the Services after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
